Palestine as a Waqf

In the Hamas charter, and as they repeatedly state, Palestine is considered a Waqf. This is an Arabic term for a trust or an endowed property, similar to how bank deposits or even banks themselves are held.

It was entrusted, not given, by God to Muslims until the Day of Judgment. The believers, even if they wanted to, could not give away something that doesn't belong to them.

In reality, Gaza was left to the Arabs as an independent (though not formally recognized) state. Since then, attacks against Israel have consistently originated from Gaza, leading from one disaster to the next.
