Unconstitutionality
To me, the problem does not lie in the
constitutional principles themselves, but in how they are interpreted. In fact,
even in our Constitution, implementation is left to ordinary laws. Then came the
phenomenon whereby oversight bodies (such as the Constitutional Court) interpret
these principles creatively, deriving from them numerous provisions that are not
actually there.
For example, the Constitution never mentions homosexuals, yet today it is
claimed that their rights must be guaranteed by the Constitution. At the time,
homosexuality was even considered a crime, and I have never heard of it being
discussed in the Constituent Assembly.
This is not to say that I oppose those rights—only that they are not in the
Constitution.
