Constitution and Fascism
In reality, the ban on the reconstitution of
the Fascist Party is included in a transitional provision of the Constitution.
At that historical moment, it was understandably necessary to prohibit it, but
the idea was that in the future it might be possible again, because everyone
must be free to express their opinions and to take part in elections — this is
the foundation of a democracy.
The actual prohibition later came with the Scelba Law, but it is not part of the
Constitution itself.
What truly matters, however, is that even if someone today wanted to
re-establish the Fascist Party, they would be drowned in ridicule.
